Pesticides (CDPHE Hemp) Action Limits

The pesticides listed are not allowed in regulated hemp facility products and must not be detected during laboratory testing at the limits of quantification (LOQ) established or approved in accordance with the department’s State Public Health Laboratory, Disease Control and Public Health Response Division’s, Hemp Testing Laboratory Certification, 5 CCR 1005-5.

FAQ

What are the sample size requirements?
  • CDPHE requires both a “test” sample and a “retain” sample, each sufficient to conduct the required analyses.
  • Murray-Brown Laboratories requests you provide two (2) homogeneous containers - one for analysis and the other to be retained for 90 days.
  • The minimum sample size per container is 65 g.
How should I prepare and ship my sample?
  • Sample should represent real-world product as received by the end customer and/or be homogeneous with the batch it represents.
  • Packaging should maintain sample integrity by preventing exchange with the atmosphere.
  • Ship next day or 2nd day, avoid Saturdays and weekends.
  • If your product is normally refrigerated, pack with cold packs.
  • Non-refrigerated products can be shipped without cold packs.
  • Please do not use Dry Ice and do not freeze samples

Do you analyze marijuana / THC?
  • We do not analyze marijuana.
  • THC levels in samples submitted to Murray-Brown Laboratories must be 0.3% or less.
How do the analytes offered compare to CA?
  • Colorado pesticide regulations cover the California list plus 40 additional pesticides.
  • Colorado residual solvents have some overlap with California regulations but also include some differences.
    • Select Residual Solvents: CA List reports 19 solvent analytes per California hemp regulations, except propane.
Do you report directly to the FDA, USDA, State or any other regulatory agency?

The following rules are stated in Hemp Testing Laboratory Certification 5 CCR 1005-5

  • 2.4 A Hemp Testing Laboratory shall provide the results of any required compliance testing performed on a Sample of Industrial Hemp, Hemp Product, and Unfinished Hemp Product to the Person submitting the Sample. Quality control data associated with the Sample shall be provided when requested by the Person submitting the Sample.
    • 2.4.1 Results for Total THC compliance testing of Hemp must also be provided to the Colorado Department of Agriculture.
    • 2.4.2 Results for Total THC compliance testing of Hemp must also be provided to the United States Department of Agriculture (USDA) in accordance with federal guidelines.
  • 10.3 The laboratory shall, within 1 business day of completing Total THC analysis of a Sample, provide a copy of the COA to the submitting Hemp Cultivator and the Colorado Department of Agriculture Hemp Regulatory Program.
